मुंबई: घाटकोपरच्या रमाबाई कॉलनीत दहा दलितांचे हत्याकांड घडवणारा एसआरपीचा सब इन्स्पेक्टर मनोहर कदम याने जन्मठेपेच्या शिक्षेला दिलेल्या आव्हानांविरोधात फडणवीस सरकारने ऍड मिहीर देसाई यांना विशेष सरकारी वकील म्हणून नेमले होते.पण महाविकास आघाडीच्या ठाकरे सरकारने आता देसाई यांनाच एस सी, एस टी, व्ही जे एन टी यांच्या बढतीमधील आरक्षणाविरोधात मैदानात उतरवले आहे.
राज्य सरकारच्या या धक्कादायक भूमिकेवरून दलित- मागासवर्गीय समाजात संतप्त प्रतिक्रिया उमटू लागल्या आहेत. ऍड मिहीर देसाई यांना मनोहर कदमविरोधातील खटल्यातून त्वरित हटवण्यात यावे, अशी जोरदार मागणी पुढे आली आहे.
ऍड मिहीर देसाई यांनी अनुसूचित जाती,जमाती आणि भटक्या विमुक्तांच्या बढतीमधील घटनात्मक आरक्षणाला मे महिन्यात न्यायालयात राज्य सरकारतर्फे कडाडून विरोध केला आहे, याकडे प्रख्यात सामाजिक कार्यकर्ते ऍड संघराज रुपवते यांनी सगळ्यांचे लक्ष वेधले आहे.
आता ऍड मिहीर देसाई हे रमाबाई कॉलनीत दलितांचे हत्याकांड घडवणाऱ्या एस आर पी सब इन्स्पेक्टर मनोहर कदम याच्या विरोधातील न्यायालयीन लढाईत आंबेडकरी समाजाला न्याय कसा मिळवून देतील, असा सवाल करतानाच त्या खटल्यातून देसाई यांना त्वरित हटवावे, अशी मागणीही रुपवते यांनी केली आहे. त्यांच्या मागणीला दलित- मागासवर्गीय संघटनांचा वाढता पाठिंबा मिळू लागला आहे.
ऍड मिहीर देसाई यांना संबंधित खटल्यातून त्वरित हटवण्यात आले नाही तर त्याविरोधात प्रखर आंदोलनासाठी असंख्य संघटना एकजुटीने रस्त्यावर उतरतील, असा इशारा बहुजन संग्राम संघटनेचे प्रदेशाध्यक्ष भीमराव चिलगावकर यांनी दिला आहे.
बेछूट गोळीबार करून 10 दलितांचे हत्याकांड घडवल्याबद्दल सब इन्स्पेक्टर मनोहर कदम याला जन्मठेपेची शिक्षा सुनावण्यात आली आहे. पण त्याने त्या शिक्षेविरोधात आव्हान दिले असून 2009 पासून तो जामिनावर बाहेर आहे. मात्र जानेवारी 2010 पासून हे अपील प्रकरण अंतिम सुनावणीसाठी आजवर पुढे येऊ शकलेले नाही,
असे ऍड रुपवते यांनी सांगितले.
फडणवीस सरकारच्या काळात नियुक्ती

मनोहर कदम याने जन्मठेपेच्या शिक्षेविरोधात केलेल्या अपिलाविरोधात राज्य सरकारने प्रति आव्हान दिलेले असून फडणवीस सरकारच्या काळात या खटल्यासाठी ऍड मिहीर देसाई यांची विशेष सरकारी वकील म्हणून नियुक्ती करण्यात आली होती. मात्र हा खटला अंतिम सुनावणीसाठी पुढे आणण्यासाठी देसाई यांच्याकडून कोणतीही ठोस पावले आजवर उचलली गेली नाहीत, याकडे रुपवते यांनी लक्ष वेधले आहे.
आंबेडकरी समाजाची क्रूर थट्टा
• क्रूरकर्मा मनोहर कदम याला शिक्षा मिळण्याबाबतच्या आंबेडकरी समाजाच्या सर्व आशा आता धुळीला मिळाल्यात जमा आहेत, अशी खंत व्यक्त करून ऍड संघराज रुपवते म्हणाले की, आता तर मुख्यमंत्री उद्धव ठाकरे यांच्या सरकारने बढतीमधील आरक्षणाविरोधात ऍड मिहीर देसाई यांनाच अनुसूचित जाती, जमाती आणि भटक्या विमुक्तांविरोधात मैदानात उतरवले आहे. ही बौद्ध- आंबेडकरी समाजाची क्रूर थट्टाच आहे.
• ऍड संघराज रुपवते हे रमाबाई कॉलनी पोलीस गोळीबाराविरोधातील लढ्यामधील अग्रणी असून ज्येष्ठ काँग्रेस नेते, माजी मंत्री दिवंगत दादासाहेब रुपवते यांचे सुपुत्र आहेत.

Ambedkarites people in state have strongly demanded removal of Senior Counsel Mihir Desai from the case of SRPF PSI Manohar Kadam’s appeal against his conviction in brutal police firing at Ghatkopar Ramabai colony on 11 th July 1997.
Advocate Sanghraj Rupwate and other Ambedkarites have urged the Maharashtra Government to remove Senior Counsel Mihir Desai, from the case of Police Officer Manohar Kadam, convicted in the 1997 Ramabai Ambedkar Nagar firing case, saying that Desai supported the government’s decision to scrap 33 per cent reservation in promotions to SC,ST and VJNT.
The state government, by a Government Resolution on May 07, scrapped the reservation in promotion to the Scheduled Caste (SC) Scheduled Tribe (ST), Nomadic Tribe (NT), Special Backward Class (SBC) etc. and stated that instead of giving promotions on reservations, the promotions would be given based on the seniority.
During the hearing on May 25, of the bunch of petitions filed in the Bombay High Court, challenging the above decision, Advocate Mihir Desai, appeared on behalf of the state government and justified the government resolution and opposed the reservations in promotions to SC, ST, NT and SBC.
Advocate Rupwate maintained that this was a conflict of interest and they have lost confidence in Advocate Mihir Desai. Besides, Desai is also the special counsel representing the state government in the Manohar Kadam conviction case. However he has done precious little to expedite the hearing of that case.
Ten people were killed and 12 others were injured in a police firing at Ramabai Nagar in Ghatkopar on July 11, 1997. The firing was said to be ordered by SRPF unit led by PSI Manohar Kadam. The authorities had claimeId that the firing had become imperative since the mob was about to put an LPG tanker ablaze. However Advocate Rupwate alleged that the then Shiv Sena-BJP Government and the administration, including the Mumbai Police, made attempts to shield the guilty, by fabricating a false story of the LPG Tanker.
Subsequently the government set up the Justice S D Gundewar Commission, which indicted PSI Kadam and highlighted the factum of the injuries on the vital parts (ie above the waist) of the deceased.
After many trials and tribulations, including several Public Interest Petitions, the Report of the Gundewar Commission was tabled in the Maharashtra Legislature. After that the FIR was registered and the charge sheet was filed. After the hearing, Mumbai Sessions court convicted PSI Kadam for an offence punishable under Section 304-I of the Indian Penal Code, 1860 and he was sentenced for the imprisonment for life.
• However PSI Kadam appealed (No 441/2009) in the Bombay high court against the Sessions court’s ruling. The appeal was admitted in May 2009 and he was granted bail during the pendency of the appeal.
• On January 19, 2010, the Paperback in the appeal was ready and the record and proceedings were also received. However, due to the backlog of the cases, the appeal is still pending for the final hearing. According to Advocate Rupwate, Desai did not take any step to expedite the hearing of the appeal. As such justice has remained a distant dream and hopes of the Ambedkarites have been shattered. Bhimrao Chilgaonkar, Maharashtra President of “Bahujan Sangram” organisation has also extended its support to the demand.
Adv Mihir Desai was appointed by the then Chief Minister Devendra Fadanvis government as a Special Public Prosecutor in the case of an appeal filed by PSI Manohar Kadam of SRPF convicted in the Ramabai Nagar firing incident of 1997. But surprisingly, now the Uddhav Thackeray govt has appointed Senior Counsel Mihir Desai, to oppose the reservations in promotions to Dalits and other castes.

The “Bahujan Sangram” organisation has also extended its support to the demand raised by Advocate Sangharaj Rupawate to remove Advocate Mihir Desai from the Manohar Kadam appeal case. Besides several Dalit and backward class organisations are expected to unite and take to streets to demand Mihir Desai’s removal.
